These Terms of Service ("Terms") form a binding contract between you and BANSI FOOD AND BEVERAGES LIMITED ("Bansi", "we", "us", or "our"), a company incorporated in England and Wales under company number 16044961, with its registered office at Unit 4 Hamilton Parade, Groveley Road, Feltham, England, TW13 4PJ, United Kingdom, regarding your use of bansifood.store, our mobile applications, and any goods or services we provide (together, the "Services"). By accessing or using the Services you agree to these Terms. If you do not agree, please do not use the Services.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK law.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to place an order. By using the Services you represent that you meet this requirement and have the legal capacity to enter into a contract.

2. Account Registration

Some features of the Services require an account. You agree to provide accurate, complete, and current information, to keep your password confidential, and to be responsible for all activity under your account. Notify us promptly at hello@bansifood.store of any unauthorised use.

3. Orders, Pricing & Availability

• All orders are offers to purchase, subject to acceptance by Bansi. We may decline or cancel an order at our discretion (e.g. for stock-outs, suspected fraud, or pricing errors).
• Prices are displayed in GBP and are inclusive of UK VAT where applicable, unless stated otherwise. Shipping is calculated at checkout based on the destination.
• We make reasonable efforts to ensure accuracy in product descriptions, images and pricing. Despite this, errors can occur; if we discover an error after acceptance, we will contact you with options to confirm or cancel the order.
• Some products are limited-batch or seasonal and may sell out without notice.

4. Shipping & Delivery

We ship through Royal Mail and certified third-party logistics partners. Estimated delivery windows are provided at checkout but are not guaranteed. Risk of loss passes to you upon delivery. Orders shipped outside the United Kingdom may incur duties and import taxes payable by the recipient.

5. Returns, Cancellations & Refunds (UK Consumer Rights)

• If you are a consumer in the United Kingdom, you have the right to cancel most online orders within 14 days under the Consumer Contracts Regulations 2013, save for the limited exceptions below.
• Perishable food and beverage products and goods sealed for hygiene reasons are exempt from the 14-day cancellation right once delivered, in line with the Consumer Contracts Regulations 2013, regulation 28.
• If a product arrives damaged, defective, or not as described, contact us within 30 days of receipt with photographs. Under the Consumer Rights Act 2015 you are entitled to a refund, replacement or repair as applicable.
• Approved refunds are processed to the original payment method within 14 days of acceptance.

6. Allergens & Dietary Information

Our products are or will be produced to UK food-safety standards. Allergen declarations follow UK FSA labelling requirements (Natasha's Law / FIC Regulation 1169/2011 as retained in UK law). Bansi products may contain or be produced in facilities that handle nuts, seeds, dairy, gluten, soy, mustard and sesame. If you have a severe allergy, please contact us before purchase. We are not liable for adverse reactions where allergen information has been clearly stated on the product.

7. Intellectual Property

The Services and all content within them — including text, graphics, logos, photographs, packaging artwork, recipes, software, and the BANSI name and marks — are the property of Bansi or its licensors and are protected by UK copyright, trade mark and other intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent, except for permitted personal, non-commercial use.

8. User Content

If you submit reviews, photographs, comments, or other content through the Services, you grant Bansi a worldwide, royalty-free, non-exclusive, perpetual, irrevocable licence to use, reproduce, modify, publish, and display that content in connection with our business. You represent that you own or have the necessary rights to grant this licence and that your content does not violate any law or third-party right.

9. Acceptable Use

You agree not to:

• Use the Services for any unlawful, fraudulent, or abusive purpose.
• Attempt to gain unauthorised access to any part of the Services, our systems, or other users' accounts.
• Interfere with or disrupt the Services, networks, or servers.
• Reverse-engineer, decompile, or attempt to derive source code from any software we make available, except to the extent permitted by UK law.
• Scrape, harvest, or extract data from the Services using automated means without our prior written consent.
• Upload viruses, worms, or other malicious code.
• Use the Services to harass, defame, or harm any person.

10. Mobile Applications

Where you download a Bansi mobile application, the following additional terms apply:

• We grant you a limited, non-exclusive, non-transferable licence to install and use the App on a device you own or control, solely for personal use.
• The App is provided through the Apple App Store or Google Play, and your use is also subject to those platforms' terms.
• Apple and Google are not parties to these Terms and have no obligation to provide support or maintenance for the App.
• You agree to comply with applicable UK and international export-control laws when using the App.

11. Third-Party Services

The Services may integrate with or link to third-party services (e.g. payment processors, analytics, social platforms). Bansi is not responsible for those third-party services and your use of them is governed by their own terms.

12. Disclaimers

To the maximum extent permitted by applicable UK law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, save for warranties that cannot be excluded under the Consumer Rights Act 2015. We do not warrant that the Services will be uninterrupted, error-free, or secure, nor that any defects will be corrected.

13. Limitation of Liability

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under UK law, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights. Subject to that, in no event shall Bansi be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Our total cumulative liability under these Terms shall not exceed the greater of (a) the amount you paid Bansi in the 12 months preceding the claim, or (b) £100.

14. Indemnification

You agree to indemnify and hold harmless Bansi and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Services.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, including if we believe you have violated these Terms. Upon termination, the rights and licences granted to you will cease. Sections that by their nature should survive termination (including 7, 8, 12, 13, 14, 17) will continue to apply.

16. Modifications

We may revise these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent version. Material changes will be notified via the Services or by email where appropriate. Continued use after changes take effect constitutes acceptance.

17. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of these Terms or the Services, save that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in your local courts. We encourage you to contact us first at hello@bansifood.store so we can attempt to resolve any issue informally.

18. Force Majeure

Bansi shall not be liable for any failure to perform under these Terms due to causes beyond our reasonable control, including acts of God, war, natural disaster, pandemic, government action, labour dispute, supply-chain failure, or telecommunications outage.

19. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and Bansi regarding the Services and supersede any prior agreements.
